Terms of Use

These Terms explain the basic rules for using Unfound Earth. By creating or using an account, you agree to these Terms. If you do not agree, do not create or use an account. Please also read our Privacy Policy.

Who we are

Unfound Earth is operated by Rory Duncan, trading as Unfound Earth. Contact details are at the end of these Terms.

Who can use Unfound Earth

You must be at least 18 years old to create or use an account. The service does not currently verify age.

What the service provides

Unfound Earth is a place-discovery and personal collection service. You can browse places, use editorial information to help plan a visit, mark places FOUND, and follow your collection and progression.

Unfound Earth is not a tour operator, travel agent, mountain guide, emergency service, access authority, weather authority or safety-certification service. It does not provide guaranteed turn-by-turn navigation or verify that you visited a place.

Your account

Sign-in uses a code or link sent to your email address; Unfound Earth does not ask you to create an app password. Use an email address you are entitled to use, keep access to it reasonably secure, and do not use another person's account. Contact us if you think someone else is using your account.

FOUND, XP and your collection

FOUND is an honour-system record. Only mark a place FOUND when you consider that you have genuinely completed your visit or find at that place. You can record an earlier visit; you do not need to be at the place when you record it. We do not require GPS, photographs or other proof, and do not independently verify physical attendance. A FOUND record is private to your account and adds the place to your collection.

A place's XP is awarded once, the first time you mark it FOUND. Repeating the action does not award more XP. XP, levels, rarity and collection progress are product progression only. They have no cash or monetary value, are not property or an investment, and cannot currently be redeemed for money, goods or services. There are no paid account features in the current service.

Rarity is an editorial measure of collectibility, not a measure of danger, difficulty, remoteness or accessibility.

We may change place XP, rarity, the catalogue and how progression is displayed. Past awards may be preserved, but we do not promise that every progression feature or catalogue entry will remain unchanged.

Visiting places and outdoor activity

A visit may involve weather, terrain, traffic, water, cliffs or steep ground, remoteness and other changing or location-specific hazards. Use your own judgement about whether and when to go, your route, clothing and equipment, fitness and capabilities, transport, and current local conditions. Follow signs and restrictions.

Unfound Earth provides ideas and planning information, not a decision that a visit or route is suitable for you. Check current local information and authoritative sources before setting out.

Maps, weather, daylight and planning information

Maps show place locations. Where we link to routes or navigation services, those are provided by others. Map positions and external route information can be incomplete or wrong. Check your route, access, restrictions, signs and current path or road conditions. Unfound Earth does not provide guaranteed turn-by-turn navigation.

Weather shown in the app is general local weather for the surrounding area, not a mountain forecast for the exact place. It can change quickly or be delayed or inaccurate, and should not be your only source for a safety-critical decision. Where available, a regional Met Office mountain forecast is linked separately; it is an external service and not a forecast for every exact location.

Sunrise, sunset and daylight information is an astronomical planning estimate. It does not account for terrain, cloud, woodland, your route or how long your visit will take, and does not determine when it is safe to travel.

Place information and access

We make reasonable efforts to keep editorial place and visit information useful, but paths, land access, parking, opening arrangements and facilities can change. Sites may close temporarily, and weather, terrain, construction or restrictions may differ from descriptions or photographs.

A place being listed does not guarantee that it is open, legally accessible at every time, on a public right of way, suitable or accessible for you, safe, or of a particular difficulty. Check with landowners, local authorities, signs and other current authoritative sources where appropriate.

Using the service appropriately

Do not use Unfound Earth unlawfully, interfere with or disrupt the service, try to access accounts or systems without permission, or exploit technical weaknesses to manipulate FOUND, XP or progression.

External services and links

Maps, weather, routes, visitor resources and photography source or licence pages may be provided or hosted by others. External sites and services have their own content, availability, terms and privacy practices, which Unfound Earth does not control. A link does not mean that we guarantee or endorse everything on that service.

Content, photography and intellectual property

Unfound Earth branding and original material we create for the service, such as its software, design and written descriptions, are protected by applicable intellectual-property rights. You may use the service for personal, non-commercial purposes under these Terms; this does not transfer ownership of our material to you.

Place names and public facts are not claimed as our property. Official place photographs and other third-party materials remain subject to their respective owners' rights and licences. We show attribution where required. Seeing an image in the service does not give you a right to reuse it; check its stated licence and source. The current service does not let users upload personal photos or memories.

Changes and availability

Unfound Earth is an evolving service. We may update or discontinue features, change the catalogue or progression, and depend on external services that may change or become unavailable. The service may also be interrupted for maintenance or other reasons. We do not promise uninterrupted availability.

Account deletion, suspension and ending the service

You can delete your account from Account. This removes your sign-in account, application profile and FOUND records, and with them your personal collection and progression. See the Privacy Policyfor details about data handling and information that may remain temporarily in provider systems.

We may restrict or suspend access where reasonably necessary to address unlawful use, serious misuse, a material breach of these Terms or a security risk, or to protect the service and its users. We may also end or materially change the service. Where appropriate, we will give notice. This does not remove rights you have under applicable law.

Liability and your legal rights

Place, route, weather and daylight information is provided to help with discovery and planning, not as a guarantee of current conditions or a substitute for your judgement and up-to-date local information.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights. Nothing here affects other rights that applicable law does not allow us to exclude or limit.

Privacy

Our Privacy Policy explains how Unfound Earth uses personal information.

Changes to these Terms

If we make material changes, we will update the date above and provide reasonable notice where appropriate. The updated Terms apply from the date shown, subject to any rights you have under applicable law.

Governing law

These Terms are governed by the law of England and Wales. If you are a consumer resident elsewhere in the UK, mandatory protections and court rights available where you live continue to apply.
